What Is Mediation?

Personal injury cases deal with accidents that were caused by negligence. If you sustain car accident injuries because a driver was acting irresponsibly, then accident attorneys would be able to help you file a lawsuit. These accidents are tragic and preventable, which is why legal services work hard to secure verdicts and settlements that the injured party deserves.

At The Bourassa Law Group, our personal injury lawyers know that no amount of money can make up for incidents that leave you physically and emotionally traumatized. However, we help our clients identify and achieve positive and cost-effective legal solutions. This means that medical bills and property damages can be paid easily, and the negligent party is held accountable for their actions.

Although claimants can opt to litigate (go to court), most cases are settled out of court through mediation, an alternative form of dispute resolution. Mediation is an inexpensive and usually quicker way for the injured party to attain compensation.

How It Works

When you choose to litigate, you have to wait for a court date, which is often several months away. With mediation, you can quickly book a mediator and organize meetings at your convenience. The cost is generally split between the plaintiff and the defendant.

The mediator’s role isn’t to make a decision or support either party. They have to be impartial and facilitate open communication to move the conversation forward. They keep the peace as well as suggest creative solutions that work for both parties.

The goal isn’t to exact the truth or to serve justice; it’s to reach an agreement that both parties are willing to sign off on.

What If You Can’t Reach A Conclusion?

In some cases, one or both parties are unwilling to accept each other’s terms. If mediation is unsuccessful, then the next option is litigation. Both parties will continue towards trial. However, this also means that the outcome is also outside of their control.

The judge, and in some cases, the jury will make a ruling based on the case’s particulars, and this will be final.

How Do You Know When Mediation Is The Right Choice?

Mediation is designed to give the parties the opportunity to take control over the outcome of their own case and find a resolution they can both live with. If the parties cannot find that resolution, they will need to make sure they are represented by a law firm that can lead them successfully through trial.

. It’s not always clear, and the right course of action is contingent on many things, which is why it’s best to get input from personal injury attorneys before you decide.
